RETURN AND REFUND POLICY

1. GENERAL POLICY

St. Augustine Marina operates on a NO RETURNS, NO REFUNDS policy for all purchases unless otherwise specified in this document or required by law. All sales are considered final at the time of purchase unless the circumstances outlined below apply.

By making a purchase at St. Augustine Marina, whether in-store or through our authorized online sales channels (including eBay), customers acknowledge and agree to this return and refund policy.

2. SCOPE OF POLICY

This policy applies to all products and services sold by St. Augustine Marina, including but not limited to:

  • Fishing gear and tackle
  • New boats
  • Pre-owned boats
  • Archery equipment (crossbows, compound bows, and accessories)
  • Yamaha outboard engines (new)
  • Yamaha Marine parts and accessories
  • Service and repair work (Yamaha outboard engines, Evinrude Johnson engines, bows, fishing rods and reels)

3. EXCEPTIONS TO NO REFUND POLICY

3.1 Defective Merchandise

If merchandise is found to be defective upon delivery or first use, customers must:

  • Notify St. Augustine Marina within 48 hours of purchase or delivery
  • Provide proof of purchase (receipt or invoice)
  • Return the item in its original condition with all packaging, manuals, and accessories
  • Demonstrate the defect to store personnel

St. Augustine Marina will, at its sole discretion:

  • Replace the defective item with an identical item (subject to availability)
  • Offer a store credit for the purchase price
  • Repair the item at no charge
  • Process a refund to the original payment method

3.2 Incorrect Item Shipped or Delivered

If St. Augustine Marina ships or delivers an incorrect item, customers must notify us within 48 hours. Upon verification, we will arrange for return of the incorrect item and delivery of the correct item at no additional charge to the customer.

3.3 Special Order Items

Special order items are non-refundable and non-returnable once ordered, as they are specifically procured for individual customers. Customers will be informed when an item is considered a special order prior to purchase.

3.4 Management Discretion

St. Augustine Marina reserves the right to authorize returns, exchanges, or refunds on a case-by-case basis at the sole discretion of management, considering factors such as:

  • Circumstances of the purchase
  • Customer history and relationship with the business
  • Nature of the complaint or issue
  • Business goodwill considerations

Such exceptions do not create precedent or obligation for future transactions.

4. MANUFACTURER WARRANTIES

4.1 Yamaha Marine Products

As an authorized Yamaha Marine sales and service dealership, St. Augustine Marina facilitates warranty registration and warranty claims for all Yamaha Marine products, including outboard engines, parts, and accessories.

  • All Yamaha Marine products are covered by the manufacturer’s warranty as specified in Yamaha’s warranty documentation
  • Warranty service is performed in accordance with Yamaha Marine warranty policies and procedures
  • Warranty coverage, terms, and limitations are determined solely by Yamaha Marine
  • St. Augustine Marina will assist customers with warranty registration and claims processing
  • All Yamaha Marine promotional offers, incentives, and extended warranty programs are honored as specified by the manufacturer

Customers should refer to their Yamaha Marine warranty documentation for complete terms and conditions. Warranty service does not supersede this return policy.

4.2 Other Manufacturer Warranties

Products from other manufacturers may carry their own warranties. St. Augustine Marina will provide available warranty information at the time of purchase. Warranty claims for non-Yamaha products must be directed to the respective manufacturers unless otherwise arranged.

5. BOATS (NEW AND PRE-OWNED)

5.1 New Boats

All new boat sales are final. No returns or refunds will be issued on new boats. New boats may be covered by manufacturer warranties; warranty service will be provided in accordance with manufacturer specifications.

5.2 Pre-Owned Boats

All pre-owned boat sales are final and sold “AS IS” unless otherwise specified in writing in the purchase agreement. Customers are strongly encouraged to:

  • Conduct thorough pre-purchase inspections
  • Arrange for independent marine surveys at their own expense
  • Request sea trials where applicable
  • Review all condition disclosures carefully

Any representations regarding pre-owned boat condition are provided as a courtesy and do not guarantee specific performance or create warranty obligations unless expressly stated in writing.

6. OUTBOARD ENGINES

6.1 New Yamaha Outboard Engines

  • All sales are final
  • Covered by Yamaha Marine manufacturer warranty
  • Warranty registration completed at time of purchase
  • Warranty service performed at St. Augustine Marina in accordance with Yamaha specifications

6.2 Pre-Owned Outboard Engines

  • All sales are final
  • Sold “AS IS” unless written warranty provided
  • Pre-purchase inspection strongly recommended
  • No implied warranties of merchantability or fitness for a particular purpose unless required by law

6.3 Other Brand Engines (Service Only)

St. Augustine Marina services Evinrude and Johnson engines but does not sell new units of these brands. Service work on these engines is covered under Section 8 of this policy.

7. FISHING GEAR, ARCHERY EQUIPMENT, AND ACCESSORIES

7.1 General Provisions

All sales of fishing gear, archery equipment (including crossbows, compound bows), and related accessories are final. No returns or exchanges except as outlined in Section 3 (defective merchandise or incorrect items).

7.2 Safety Notice

Archery equipment, including crossbows and compound bows, are potentially dangerous items. Customers are responsible for:

  • Using products safely and in accordance with manufacturer instructions
  • Ensuring proper training and competency before use
  • Complying with all applicable federal, state, and local laws regarding possession and use
  • Understanding that St. Augustine Marina is not liable for injury or damage resulting from misuse

Once archery equipment leaves the store, it cannot be returned due to safety and liability considerations.

8. SERVICE AND REPAIR WORK

8.1 General Service Policy

St. Augustine Marina provides professional service and repair for:

  • Yamaha outboard engines
  • Evinrude and Johnson outboard engines
  • Bows (crossbows and compound bows)
  • Fishing rods and reels

8.2 Service Guarantees

  • All warranty service work is guaranteed for 30 days from date of completion for parts and labor provided by St. Augustine Marina 
  • This guarantee covers workmanship and parts installed during the service
  • This guarantee does not cover damage caused by misuse, normal wear and tear, or unrelated failures
  • Customer must notify St. Augustine Marina within 30 days if service-related issues arises
  • This service guarantee does not apply to Evinrude Johnson parts, engines, or related service. 

8.3 Diagnostic Fees

Diagnostic fees are non-refundable once diagnostic work has commenced, regardless of whether subsequent repairs are authorized or completed.

8.4 Service Refunds

Refunds for service work will only be issued if:

  • Service was not performed as agreed
  • Incorrect service was performed due to St. Augustine Marina error
  • Parts were charged but not installed (verified by customer and management)

Customers disputing service charges must provide specific details in writing within 7 days of service completion.

8.5 Warranty Service

Warranty service performed under manufacturer warranty programs (particularly Yamaha Marine) is subject to manufacturer approval and guidelines. St. Augustine Marina acts as a facilitator for warranty claims and cannot override manufacturer warranty decisions. 

  • Evinrude Johnson warranty service may only be performed on engines purchased in 2019. Warranty acknowledgement is subject to BRP approval and may not be valid at time of service provided due to extenuating circumstances. 

9. ONLINE SALES (EBAY)

Products sold through St. Augustine Marina’s eBay store are subject to:

  • This return and refund policy
  • eBay’s policies and buyer protection programs
  • Any specific return terms stated in the individual eBay listing

In the event of conflict between this policy and eBay’s requirements, eBay’s policies will govern to the extent required by eBay’s seller agreement. However, our default position remains no returns or refunds unless required by eBay or qualifying under Section 3 of this policy.

10. REFUND PROCESSING

When a refund is authorized under this policy:

  • Refunds will be issued to the original payment method within 7-10 business days of approval
  • Cash purchases will be refunded in cash or check at management discretion
  • Credit card refunds will be processed to the original card used for purchase
  • Store credit may be offered as an alternative to refund at customer’s option
  • Shipping costs, if applicable, are non-refundable unless the return is due to St. Augustine Marina error

11. RESTOCKING FEES

If a return is authorized at management discretion, a restocking fee of up to 25% of the purchase price may apply, depending on:

  • Condition of returned merchandise
  • Original packaging and completeness
  • Ability to resell the item as new
  • Nature of the return reason

Restocking fees will be communicated to the customer before processing any authorized return.

12. EXCHANGES

Exchanges may be authorized by management as an alternative to refunds. Exchanges are subject to:

  • Product availability
  • Equal or greater value (customer pays difference if exchanging for higher value item)
  • Returned item meeting return condition requirements
  • Same restrictions as refund policy

Exchanges do not create an entitlement to future exchanges or returns.

13. CUSTOMER RESPONSIBILITIES

To be eligible for any return, refund, or exchange consideration, customers must:

  • Retain proof of purchase (receipt, invoice, or order confirmation)
  • Inspect purchases immediately upon receipt or pickup
  • Report defects or errors within specified timeframes
  • Return items in original condition with all packaging, parts, manuals, and accessories
  • Not use, alter, or modify products prior to requesting return (except for initial testing to identify defects)
  • Comply with all terms of this policy

14. NON-RETURNABLE ITEMS

The following items are non-returnable under any circumstances except where required by law:

  • Special order items
  • Items that have been used, installed, or modified
  • Items without original packaging and accessories
  • Items purchased for events, tournaments, or time-sensitive purposes after the event/date has passed
  • Clearance, closeout, or “as-is” items specifically marked as final sale
  • Gift cards
  • Downloadable products or services already rendered

15. LIMITATION OF LIABILITY

St. Augustine Marina’s liability for any claim relating to purchased products or services is limited to the purchase price paid by the customer. We are not liable for:

  • Consequential, incidental, or indirect damages
  • Lost profits or revenue
  • Loss of use
  • Costs of substitute products or services
  • Property damage not directly caused by our negligence
  • Personal injury except as provided by law

This limitation applies to the fullest extent permitted by Florida law.

16. “AS IS” SALES DISCLAIMER

Unless otherwise expressly stated in writing, all merchandise, particularly pre-owned boats and engines, are sold “AS IS, WHERE IS” with all faults. St. Augustine Marina makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, except as required by applicable law.

Customers purchasing “AS IS” items acknowledge that they have inspected the items or waived inspection and accept them in their current condition.

17. CANCELLATIONS

17.1 Customer-Initiated Cancellations

Orders may be cancelled before shipment or delivery at management discretion. Once an order has been shipped, delivered, or installed, it cannot be cancelled and is subject to this return policy.

17.2 Deposits

Deposits on special orders, boats, engines, or services are non-refundable unless St. Augustine Marina is unable to fulfill the order due to circumstances within our control.

18. DISPUTE RESOLUTION

Customers with concerns about purchases or service should:

  • Contact St. Augustine Marina management in person or by phone
  • Provide detailed information about the issue, including receipt or invoice
  • Allow reasonable time for investigation and resolution

St. Augustine Marina is committed to customer satisfaction and will work in good faith to resolve legitimate concerns.

19. MODIFICATIONS TO POLICY

St. Augustine Marina reserves the right to modify this return and refund policy at any time. Changes will be effective immediately upon posting at our store location and on our website/online sales channels. The policy in effect at the time of purchase governs that transaction.

20. GOVERNING LAW

This policy and all transactions are governed by the laws of the State of Florida and applicable federal law. Any disputes shall be resolved in the courts of St. Johns County, Florida.

21. SEVERABILITY

If any provision of this policy is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
